What are the different types of Trusts?

There are several types of Trusts which you can create, depending on how you want to control your assets.

Bare Trust

This is a basic Trust where the beneficiary has the right to the capital, assets, and income within it. 

Interest in Possession Trust

This Trust is designed so the beneficiary has the right to receive the generated income of said Trust or have the right to enjoy the trust’s assets in some other manner.

Discretionary Trust

A Discretionary Trust allows the trustees to decide how much the beneficiaries receive from the Trust meaning that entitlements to beneficiaries are not fixed. 

Accumulation Trust

With this trust, the trustees have authority to collect income within said trust and add it to the overall capital. They may also have the option to distribute this income, much like a Discretionary Trust. 

Mixed Trust

A mixed trust encompasses more than one type of trust. Each section of that trust is subject to their own individual tax rules and regulations.

Settlor-Interested Trust

This trust is set up so the settlor, spouse or civil partner gains benefits from said trust. 

Non-Resident Trust

A Non-Resident Trust is used for when the trustees of said trust are not based within the UK.

A witness to a declaration of trust must match the following criteria. They cannot be one of the other owners or beneficiaries of the trust. They should also have no family connections to either party.

Yes, a declaration of trust can be changed as long as both parties agree to this, only then can the trust be changed or rewritten.

You cannot revoke a declaration of trust, unless both parties agree to it.

Yes, joint tenants can have a declaration of trust. It is common for joint tenants to do this.

The majority of trusts that are created need to be registered. However, there are some exceptions. Trusts that are imposed by a court for example, do not need to be registered. It is best to contact our solicitors for expert advice as to whether you need to register yours.

If a couple decides to get married and they have a declaration of trust together, the trust will be superseded by the marriage.

Yes, you can execute a declaration of trust after a purchase. However, it is recommended that you get the trust in place before the purchase. This is because none of the parties involved are obliged to sign it once the purchase is final.

I cannot fault the service I received from Eric Robinson bitterne branch. Samantha Gilby was our conveyancer and she was absolutely brilliant from beginning to end. Our purchase went from offer to completion in just under 11 weeks. She was so helpful and her communication was brilliant. I would highly, highly recommend.

Superb personal support

I had recent dealings with Chelsea at Eric Robinson solicitors in relation to a workplace legal requirement I had. Initially I contacted 2 other local firms, but in-between feeling pushed upon, over quoted and slightly sidelined, I was fortunate enough to speak with Chelsea Marsh at ER.
