When should I apply for a lease extension?
In general, it is best to apply for a lease extension before it reaches 80 years. This is because some lenders require a minimum number of years to be remaining, and/or the premium associated with extending the lease increases when it drops below 80 (due current legalities around marriage value).
Why should I apply for a lease extension?
There are various reasons to apply for a lease extension, the main ones being to protect the property value, for security and peace of mind, for property marketability and to lower or remove ground rent.
Is the Government making it easier for lease holders to extend their lease?
The Leasehold and Freehold Reform Bill was introduced to Parliament on 27 November 2023 which aims to make it ‘easier, faster, fairer and cheaper’ for leaseholders to extend their lease or purchase their property’s freehold. Legislation is expected to be passed before the next general election and will reflect elements such as (but not limited to), the removal of marriage value and offering much longer lease terms.
How much does a lease extension cost?
The cost of a lease extension varies based on a number of factors. For example, the value of the property, the number of years left on the lease, how many years you wish to add, and what the negotiations look like with the freeholder.
How long does a lease extension take?
Completing the lease extension process typically takes somewhere between 3 and 12 months.
Can the freeholder refuse a lease extension?
If you have held the lease for your property for 2 years or more, you will normally have a statutory right to extend it.
Do you pay stamp duty on a lease extension?
Stamp Duty Land Tax is only payable on lease extension premiums worth more than £250,000, the same as when buying freehold land.
