Change of name FAQs
Am I able to change my name as an adult?
You can change your name by adding new names and deleting old names.
How do I do this?
This is most commonly done by Change of Name deed although there are other options. We can advise you on the appropriate process.
Is it a complicated process?
Generally speaking, it should be straightforward. However, this will depend on the exact circumstances.
Can a child name be changed?
An adult who has Parental Responsibility for a child is free to change the child’s name on the child’s behalf. However, if more than one person has Parental Responsibility for the child, each person who has such Parental Responsibility must agree to the change of name in writing.
How can a child’s name be changed?
Subject to the point above, an adult is free to change the child’s name by giving the child new names and deleting the child’s old names.
What happens if I am separated from the parent of my child?
In order to prepare the Change of Name deed, we will first need to obtain the written consent of everybody with Parental Responsibility. In certain circumstances, the consent of the court may also be required.
We will also need the adult completing the change of name deed to sign a declaration confirming that they take responsibility for the written consent that they have provided.
What is the process?
We will prepare the deed for you, meet with you to explain the deed, witness you sign the deed and return the original deed plus certified copies to you for your future use.
What is a deed poll?
A deed poll simply refers to the name of the legal documentation that proves your change of name.
