The Family team at Eric Robinson Solicitors are delighted to learn that the government will be introducing legislation to make “no fault” divorce an option for separating couples.
Following the well documented case of Owens v Owens in which it was decided that Mrs Owens has to wait five years in order to divorce her husband; there has been a campaign to promote no fault divorce, which the Family team at Eric Robinson has been proud to support.
We believe that the change in the law is needed as currently in the absence of consent or evidence of fault, separating couples have to live apart for 5 years before they can get divorced. As such, this can often make an already highly charged situation worse. This delays the couple being able to regain complete independent financial control from each other and can place additional strain upon making appropriate arrangements for any children of the family.
By introducing “no fault” divorce, this will give couples wider discretion in how they can bring their marriage to end. In our view, this is a positive development and will hopefully enable parties to divorce in a less hostile and more amicable manner in the future.
