Alternative dispute resolution

Alternative dispute resolution (ADR) is a useful tool for reducing the need to utilise the courts during a dispute. There are four, key methods, one of which is usually appropriate for both parties included in a dispute. These can save considerable time and costs, and at Eric Robinson, we are experienced in all four ADR principles.

Negotiation stands as the fundamental cornerstone of ADR, facilitating direct dialogue between conflicting parties. It provides a platform for disputants to openly address their grievances, interests, and apprehensions, providing an opportunity to arrive at a resolution that satisfies all involved.

Mediation enlists the aid of an impartial intermediary, known as the mediator, to aid disputing parties. This mediator serves to facilitate communication, and unravel concerns, all the while steering the parties towards a mutually beneficial outcome that addresses their respective needs.

Arbitration represents a structured ADR procedure wherein an impartial third party, known as the arbitrator, hears arguments from both disputing factions and issues a conclusive ruling. The arbitration process generally mirrors the proceedings of a court trial.

Conciliation generally finds broader application in employment conflicts and usually precedes an employment tribunal. Similar to mediation, it aims to facilitate agreement among parties following discussions guided by a conciliator.
