Cohabitation – Fact v Fiction

According to a recent press release from Resolution (national organisation of family lawyers), “millions of unmarried couples living together are unaware that they are at severe financial risk as a result of the current legal system”.

It can be hard to separate fact from fiction when it comes to separation. For example, it is often believed that “common law marriage” exists in this country. It does not.

As a result, people often believe that as a result of their cohabiting relationship, they have rights that they simply do not have.

It can therefore compound the upset of a separation to discover that you do not necessarily have an automatic right to stay in your home or that your former partner’s only financial obligation will be towards your children rather than you.

As a result, people are often therefore unaware of the steps that they can take to protect themselves. We would always advise that legal advice is taken before you cohabit in order to prevent such issues arising. It’s not romantic but it is a pragmatic step to take.
